Elon Musk's artificial intelligence company, xAI, has filed a lawsuit against OpenAI, accusing the company of stealing trade secrets and acquiring confidential information by recruiting former xAI employees. The lawsuit was filed on September 24, 2025, in the U.S. District Court for the Northern District of California, under case number 3:25-cv-08133. In the complaint, xAI seeks damages and a jury trial, alleging that actions by the maker of ChatGPT have given it an unfair competitive edge in the AI industry.
In the center of the legal dispute are the activities of former xAI employees, including Li Xuechen, one of the company's original 20 staff members. According to the filing, Li downloaded xAI's entire codebase before leaving the company in July 2025 to join OpenAI. The company claims this data transfer was concealed and that additional sensitive information was found on Li’s devices. Beyond Li, xAI alleges that OpenAI also recruited other ex-employees, including senior finance personnel, who violated confidentiality agreements and provided inside knowledge about xAI’s internal operations, including its data center infrastructure.
The lawsuit outlines three primary allegations. First, xAI accuses OpenAI of misappropriating trade secrets under the federal Defend Trade Secrets Act (18 U.S.C. § 1836 et seq.), asserting that proprietary information and underlying technology of its Grok chatbot were unlawfully taken and exploited. Second, the company alleges intentional interference with prospective economic relations, claiming that the rival firm, led by Sam Altman, unlawfully used confidential data to undermine business relationships and potential opportunities for xAI, which is owned by Musk. Third, xAI charges OpenAI with unfair competition under California’s Business and Professions Code § 17200 et seq., asserting that the leading AI firm gained an illegal competitive advantage through its actions. Importantly, xAI has requested a jury trial to resolve these claims.
This lawsuit unfolds amid escalating legal and business tensions between Musk and OpenAI. Musk, who co-founded OpenAI, has previously criticized the organization for shifting toward a profit-driven model and has launched other legal actions related to its commercial practices. In response, OpenAI has counter-sued Musk, accusing him of harassment, further intensifying the conflict between the two AI powerhouses. Notably, just last month (August 2025), xAI and X filed a lawsuit against Apple and OpenAI in federal court in Fort Worth, Texas. That case accuses Apple and OpenAI of colluding to restrict AI market competition, giving ChatGPT an unfair advantage over competing services like xAI’s Grok chatbot. It specifically criticizes Apple for integrating ChatGPT into its devices and allegedly manipulating App Store rankings to favor OpenAI.
